Trial was supposed to start in May but was delayed again...

Trial is now scheduled for August..

The only other news is that Brian Marsden tried to get his wife out on bail but he failed...
Both remain in a Malaysian Prison...

Boy what a scam PIPS turned out to be.

It's gratifying to see someone being brought to justice on these matters....way too often it seems that these folks get of scott free.

Mr Tony Krollig of Efex International defrauded folks for some 13 million, simply declared bankruptcy and quietly went on with his life while leaving those who trusted in him somewhat worse of for wear.

That wonderful lawyer (yes Mr David Finney) who was acting on behalf of investors (?) never did bring the law to bear on this fellow......can't help but think that they themselves would have brought to account should all the facts and lack of ficuciary responsibility come to known....being the nominee directors for Tony's company.

Oh did I mention, Mr Finney was well remunerated for his "services" to investors....lawyers!

Well, I've moved on...but the scars remain....I think I'll need a damn good plastic surgeon to get rid of em!

Luckily there are legitimate ops about, you just need to make the extra effort to find them and be very diligent when conducting your due diligence. If it sounds too good to be true, well, it usually is.

Sadly, I dout that even if the PIPS folks are dealt with appropriately it won't serve as much deterrent to others..there's way too many loopholes. It truly is "buyer beware" and ultimately the responsibility does fall into the laps of those who take the plunge with their own money.

Arrived at the Seremban Courts at around 8am. Proceeded to the Sessions Court X. The court door opened at around 8.30am. Around that time, a police truck pulled around and I caught a glimpse of the couple. The notice board had the trial dates and today was especially packed.
The judge was a lady and she looked like she meant business. Certainly more proper than the ones I've encountered before.

BM and SM brought in to court with a bunch of other inmates. BM was wearing a blue, collared t-shirt, one he has worn before and SM was in a blue Police Lockup garb. As they sat down at the court, I could see that the time in prison had made both of them thinner. Sharon started to sob, but BM was on another bench with another inmate.

Earlier in the morning, I spent my time talking to two of the court officials. (Pls look out for my conversation) I had been told to the effect that it would be postponed today. I felt like SCREAMING my lungs out at the judicial system which moved at a glacial pace. Anyway, back to the court report.

It was touching 9.00am and no sign of the press but many people in court today. BM's new lawyer showed up, he was Indian, a stocky fellow with a slightly thinning hair on top. He wore and ear stud but otherwise he looked like your typical lawyer. He came and consulted the Marsden and they looked like the were in deep discusion.

The judge arived at around 9.20am and flew through a series of postponements due to lack of evidence, no medical report, new lawyer needs time for paperwork and others. A mental case, an accident case, a drug related case then a cheating case which followed our case. Their newly appointed lawyer asked that the trial to be postponed and mention that they have notified the British Authorities, for what wasn't clear to me.

Hence, the case has been postponed again to October 9th and 10th 2008. Lookout for my trip report and a bonus, I hope.

Second trial is slated for all of next week (5 days), and this trial will have to conclude after this trial is finished. Just too much ground to cover in triaal one to complete in 2 days. Will be interesting to see when they will schedule the conclusion of this first trial.

The second trial did go the entire week of 10/13-10/17 (this one is from BNM on 4 counts of running two illegal internet companies and illegal deposit taking). Ruling from the judge is expected before the 26th first trial's resumption date. In fact the ruling can come at any time now. Will be interesting to see if a guilty verdict will change the focus of the 26th trial in any way. Both trials are judge only trials.

The defense so far seems to be that it was everyone else's fault for the problems and not them. Might have worked on a jury trial, but fell flat with only a judge hearing the case. They are now being represented by public defenders. The high cost attorney dismissed himself from the case. Guess he doesn't like losing.
